Hague court rules decision in favour of Flag Telecom

The district court of The Hague, Netherlands has supported the decision of the arbitration panel saying that Videsh Sanchar Nigam Ltd (VSNL) should allow Flag Telecom an access to Flag Europe Asia Cable Landing Station in Mumbai.

 

Flag Telecom wanted access to Mumbai landing station of Flag Europe Asia cable (FEA), a submarine fiber optic cable that runs from England to Japan and passes through fifteen countries, for increasing its capacity.

 

In India VSNL controls its Mumbai landing station. Flag Telecom wants to upgrade its network from 10 Gbps to 80 Gbps due to technological advances. But for that it requires access to Mumbai landing station. However VSNL said that under Construction and Maintenance Agreement, it was not under obligation to grant access to Flag.
