CBI believes I am a dangerous man: Balwa
TT Correspondent |  |  27 Apr 2011

Swan Telecom promoter Shahid Usman Balwa, accused in 2G spectrum allocation scam, has alleged that he was the victim of the has created a  of the '''sensational falsehood'' being created by the CBIin the case and was projecting him as a ''dangerous'' man.

Balwa told the Delhi court that CBI was bracketing all the accuse in the category of dangerous people who have committed serious offence. The agency is trying to project him as a dangerous man," Balwa's counsel Majid Memon submitted before Special CBI Judge O P Saini.

Memon, who was arguing on the bail plea of Balwa, said the CBI should satisfy the court whether Balwa's physical presence in the custody has helped agency in its investigation into the case.

"There must be a compelling reason to keep me (Balwa) behind bars. Investigation vis-a-vis my custodial interrogation is over after filing of the chargesheet against me on April 2," Memon said.

He said the CBI must back its apprehensions that Balwa could tamper with the evidences or could win over the witnesses.

"What is the base for the apprehensions by the CBI that evidence could be tampered or witnesses could be influenced by Balwa. Apprehensions must have some base...A sensational falsehood has been created by the CBI," Memon said.

"This case is blown out of proportion due to some political or other reasons which I do not want to discuss now," he said.

Memon told the judge that his client is ready to abide by any condition imposed by the court if he is granted bail.Opposing Balwa's bail plea, Special Prosecutor U U Lalit said that in the chargesheet, things have been crystallised against all the accused.
"The fact remains that prima facie case is there and there are crystallised allegations against the accused in the chargesheet," Lalit said.

The court, however, deferred the arguments on bail plea for tomorrow.
During the day, Shahid Balwa's cousin Asif Balwa and Rajeev Agarwal, who are Directors of Kusegaon Fruits and Vegetables Pvt Ltd and are named in the second chargesheet filed by the CBI yesterday, were produced before the court.

The court had yesterday issued production warrants against the duo, who are in judicial custody, after their arrest on March 29.

The court has extended the judicial custody of the duo till May 6 when other three accused named in the second chargesheet have been summoned.

Besides Asif and Rajeev, CBI had chargesheeted Tamil Nadu Chief Minister M Karunanidhi's daughter Kanimozhi, Kalaignar TV Managing Director Sharad Kumar and Karim Morani, Director of Cineyug Media and Entertainment Pvt Ltd in the 2G scam.
Reliance ADAG's Surendra Pipara, who is in judicial custody after his name figured in the first chargesheet in the 2G scam, was not present before the court today as he was taken to AIIMS in connection with his medical ailments.

The court has issued production warrants against Pipara for tomorrow.
