Explain decision not to oppose Kanimozhi’s bail: SC to CBI

The Supreme Court today asked the CBI to explain on what basis it took decision not to oppose the bail plea of of DMK MP Kanimozhi and four others in the trial court in 2G scam.

A bench of Justices G S Singhvi and H L Dattu asked the Additional Solicitor General Haren Raval to make a statement before it tomorrow in this regard after it was pleaded by other accused in the case that the investigating agency should also treat them on equal footing as far as bail is concerned.

The court was hearing bail pleas of five corporate five corporate honchos who pleaded that they should be released as there is no chance of them tampering with the evidence.

The investigating agency, however, opposed the bail plea of corporate executives - Unitech Wireless'' MD Sanjay Chandra, Swan Telecom's

Director Vinod Goenka and Reliance Anil Dhirubhai Ambani group's executives Hari Nair, Gautam Doshi and Surrendra Pipara - who have approached the apex court for bail.

Earlier the agency on October 24 did not oppose the bail plea of Kanimozhi, Kalaignar TV MD Sharad Kumar, directors of Kusegaon Fruits and Vegetables Asif Balwa, Rajiv Agarwal and Bollywood producer Karim Morani before a special CBI court here.

It had, however, opposed bail plea of Swan Telecom promoter Shahid Balwa and former telecom minister A Raja's ex-private secretary R K Chandolia in the trial court.

Other accused in the case include Raja, former telecom secretary Siddhartha Behura and three telecom firms Reliance Telecom Ltd, Swan Telecom and Unitech (Tamil Nadu) Wireless Ltd. All the accused have pleaded that they have not done anything wrong and refuted the charge of drawing illegal benefits in allocation of 2G spectrum.

Facing heat from dissidents, Arunachal Pradesh Chief Minister Jarbom Gamlin today resigned, six months after he assumed office following the death of Dorjee Khandu in a helicopter crash.

A new Congress Legislature Party leader is likely to be selected tomorrow by AICC president Sonia Gandhi and will be subsequently sworn in as the new chief minister, party sources said.

Earlier in the day, 42 Congress MLAs adopted a one-point resolution authorising Gandhi to appoint a new CLP leader.

The resolution said, "We the party MLAs are authorising Sonia Gandhi to nominate the CLP leader." It was read out to mediapersons by AICC observer and Union Power Minister Sushil Kumar Shinde.

The party MLAs held a meeting where Shinde and two other observer - former DoNER minister B K Handique and party's general secretary and in-charge of Arunachal Pradesh Dhaniram Shandil - were present.

The change in leadership was demanded by a majority of Congress

MLAs led by dissident leader Nabam Tuki. On October 29 both Gamlin and his party rival PCC chief Tuki had offered to resign from their posts.

The AICC president had met both of them that evening.

The rift between Tuki and Gamlin had become a major issue dividing the party along ethnic lines in the state with the majority of Congress legislators demanding Gamlin's resignation for his alleged "authoritarian rule".

Gamlin was sworn in as chief minister on May 5 after the death of former chief minister Khandu in a chopper crash on April 30.

In the 60-member House, Congress has 42 MLAs, Trinamool Congress - 5, NCP - 5, People's Party of Arunachal - 4, BJP - 3 and Independent - one. Trinamool Congress and NCP provide outside support to the Congress government.
