RCom approaches TDSAT for additional spectrum

Reliance Communications (RCom) which was allotted4.4 Mhz spectrum in 2008 in all the circles has approached the Telecom Dispute Settlement Appellate Tribunal (TDSAT) seeking seeking GSM spectrum up to 6.2 Mhz.

RCom which was expecting to get additional spectrum the subscriber-linked criteria and without paying any additional fee said that it is entitled to the entire 6.2 Mhz under the licence agreement signed with the Government.  The company has sought direction on DoT to fulfil its contractual obligations before proceeding with the auction process.

RCom in its appeal filed with the tribunal sought protection and enforcement of its contractual rights for allocation of the balance spectrum.

The Tribunal admitted RCOM''s petition and issued notice to DoT to file its reply. Referring to the Supreme Court’s observation that natural resources could not be allotted without auction, DoT took the stand it would not be possible to allot extra spectrum to the company.
