Bharti Airtel failed to convince the Supreme Court on Friday to hold an immediate hearing against the HC’s order yesterday lifting the ban on its earlier ruling to prevent execution of DoT’s order from stopping the company to offer 3G services in circles where it does not have licenses. SC has posted the matter for April 8.
While maintaining that HC could not have acted on the plea of RCom, A M Singhvi who is representing Bharti Airtel said that the HC’s decision would affect millions of subscribers, according to ET.
RCom in its plea had said that it has paid thousands of crores for the 3G spectrum and Bharti is using it for free in as many as seven circles, therefore, disrupting the level playing field.
“If this is allowed, then there is no requirement for any licensee to participate and purchase 3G spectrum in auction. This defeats the purpose of auction.” Hence, by riding on airwaves of Vodafone and Idea, Bharti Airtel was eating into RCom’s business” it said.
India’s three major telcos Bharti Airtel,Vodafone and Idea which had won licenses for 13, 9 and 11 circles, respectively in 2010 entered into agreement with each other for offering 3G services by using each other's airwaves.
Later in December 2011, however, the government had declared these pacts as 'illegal'.
