The Supreme Court on Monday will hear the appeals of telecom operators challenging the high court next week against Dehi High Court order ruling that the Comptroller and Auditor General Auditor can audit their revenue.
The telcos argued that it may have wider implications as it can be applied across the board.
Senior lawyer Harish N Salve, appearing for telecom operators, said on Monday that his clients have no objection to the Department of Telecommunications conducting a special audit as it has a right do so.
But in the same vein he said the (high court) division bench raises the argument by a notch to say that CAG, which audits all receipts of the Union and the states going into the Consolidated Fund of India, will audit our revenue receipts.
Additional Solicitor-General Paras Kuhad said that whatever was payable to the government could be audited by the CAG. The Constitution allows special audit in certain circumstances and Parliament has authorised it under the Trai law.
The Delhi High Court on January 6 allowed CAG to audit the revenue receipts of telecom firms to examine whether they underreported revenue to pay lower licence fee to the government. |
