Leading telecom operator Bharti Airtel has got major relief with the Delhi High Court on Monday ruling that it can continue its 3G Intra-circle roaming services till its final order.
The court has posted the matter for May 8 while Airtel can keep the earnings from 3G services in a separate account. DoT is also planning to serve the similar notice on Idea and Vodafone.
"3G roaming to continue until the final order but an interim order will be passed later on Airtel's plea for stay of the government's order", said Justice Rajiv Shakdher said
Last week the department of telecommunications had sent notice to the leading telecom operator Bhrati Airtel asking it stop 3G roaming services outside its licensed zones. The court had asked Airtel to pay a penalty of Rs. 350 crore.
The government in December 2011 had declared 3G roaming pacts as 'illegal'. Through these show-cause notices these operators have been asked to pay Rs 50 crore in every circle where they were offering 3G services through roaming pacts. Telecom Minister Kapil Sibal had approved the ecommendation of a Department of Telecom committee on Rs 50 crore penalty.
