Nokia Siemens Networks (NSN) it seems is not going to let go its fight against disqualification by BSNL on technical grounds for the mega GSM order that easily. The firm has now questioned the credibility of findings of the independent panel set up by the PSU.
The panel has recently given a clean chit to BSNL’s tender process. But NSN alleged that its view points were never sought by the panel and the process followed by the panel was not fair and transparent.
Business Line reports that NSN has written to BSNL CMD stating, In our view, the process adopted by the Independent External Monitors (IEM) denuded us of a fair opportunity. Our representatives made two presentations before the IEMs and on both these occasions, the officials of BSNL were present. However, we were not invited to be present when BSNL made its presentation before the IEM.”
“Another ground on which we impeach the credibility of the IEM report is that the IEMs during their determination have considered additional documents which were never disclosed let alone shown to us at the time of hearing. This has compromised our defence in the matter and thus is arbitrary and inequitable,” said NSN.
NSN said that there has been little independent application of mind in the matter by the independent panel. The firm said that the panel has more or less echoed reasoning provided by BSNL earlier over the disqualification.
Interestingly even as NSN has decided to question the alleged favouritism in the process, its competitor Ericsson continues to enjoy the situation as it is set to bag a 5.25 million GSM line order from BSNL valued at $ 500 million. BSNL reasons that it is facing capacity crunch in some areas and hence requires to place this order urgently to Ericsson which is its existing supplier. |
